Senate President Jeff Atwater

Senate President Jeff Atwater, R-North Palm Beach, promises to preside with an open mind and an open door. He seems to be willing to examine the CSX deal, though he has yet to take a strong stand.

In his Senate organizational address, Atwater talked about education, energy, the Everglades and economic development, but said not a word about the Central Florida Commuter Rail deal and its budget-busting giveaways and subsidies.

With tax revenues down, Atwater should send the message that all spending needs closer scrutiny and he’s got questions about the CSX deal – the costliest rail sale ever negotiated.

Here’s a compromise he could offer: agree to buy the 61.5 miles of tracks for the agreed-upon $150 million. But don’t fund freight-rail improvements elsewhere. Stephanie Kopelousis, the secretary of Florida’s Department of Transportation, insists the two components aren’t linked. Take her at her word.

If this deal is truly about getting commuter rail in Orlando – and not getting taxpayers to upgrade CSX’s freight lines – the state should buy the tracks and let Central Florida get on with commuter rail.

Florida cannot afford the CSX deal as written.
It will take someone of your stature to prevent citizens from facing yet another case of enormous financial exposure.

CSX doesn't house, teach, feed, heal, protect or need my help to create a job for a Floridian. Please be true to taxpayers and expect the same from your fellow senators. I am a resident of Sundance Ranch Estates. My home and property will suffer from severe financial injury if this Intermodal/Auto transloading facility is funded to be built conjoined to my property. A federal judge, Susan Bucklew agreed with my statement but was prohibited by federal pre-emption to act on our behalf. CSX is being given $23,000,000.00 dollars of taxpayer funding in this freight deal to move their Taft operation to Winter Haven, and my family's future is being ignored. Just because the feds are sending money doesn't make this deal any better. Stimulus is the apparent savior, but having an influx of cash from the feds doesn't mean this is a good deal. I'm so sick of people lining their pockets, blatantly lining their pockets. It is disgusting. I hope Senator Atwater can see through all the crap.

There is NO guarantee of federal money for this rail to nowhere. Even if there were federal dollars, you're right it's not a good deal. Whether it's federal, state or local dollars it's ALL taxpayer money being used to enrich corporations and developers.

The first part of your statement is factually incorrect. There is no guarantee of federal funds but if you keep repeating it and tap your red shoes together, it may come true. The liability transfer is the last demand of CSX and the only one that needs legislative approval. Since you are obviously pushing for this boondoggle, can you explain how it is in the public interest to absolve CSX from having to pay for it's negligent acts and giving that honor to the taxpayers?

Do you have personal first hand knowledge of guaranteed federal money? The FTA letter seems to indicate that there is no guarantee. See "No Federal Money" under the category "Too Costly". The documentation disputes your claim.

Choo-Choo bill heats up in the Senate posted by Aaron Deslatte on Mar 4, 2009 10:27:10 AM Discuss This: Comments (0) | TrackBack (0) | Linking Blogs | Add to del.icio.us | Digg it TALLAHASSEE -- The fiercest legislative critic of Central Florida’s $1.2 billion commuter rail project got her first at-bat against the bill authorizing the state’s insurance arrangement with CSX Corp on Wednesday. The insurance bill (SB 1212) cleared its first stop in the Senate Transportation Committee by a 6-3 vote after a testy, two-hour hearing. In front a basement room packed with local SunRail backers, Sen. Paula Dockery, R-Lakeland, grilled state Department of Transportation officials over its finer points. The committee is chaired by Orlando Sen. Andy Gardiner and seven of the nine senators present Wednesday are from Central Florida. But both Dockery and Orlando Democratic Sen. Gary Siplin repeatedly voted for amendments to substantially chance the deal. Siplin also voted against the bill. Both CSX freight trains and SunRail commuter passengers would share the rail corridor through downtown Orlando, which the state is attempting to purchase for $432 million. But the state would have to hire other contractors to handle dispatching, maintenance and other tasks on the line. The deal would create a $200 million “no fault” insurance policy covering accidents that involved either CSX or commuter trains – more insurance coverage than Tri-Rail commuter trains carry in South Florida. CSX has said it won’t sell the 61-mile rail line without the insurance agreement, which is similar to other shared-line commuter lines around the country. One of the main arguments for the insurance language -- known as “indemnification” – is to bypass the legal blame-game after a wreck and more quickly settle lawsuits brought by injured passengers or other people along the tracks. DOT general counsel Alexis Yarborough said without the insurance arrangement, “we will bogged down for years in hundreds of lawsuits trying to determine who was at fault for what” after a wreck. But the concept has produced 1,000 “what ifs” over which company or government would shoulder the liability for injuries. Dockery has log argued the deal was a steal for CSX, would flood her hometown with more freight traffic, and is unneeded to bring mass transit to the region. “It’s not about commuter rail,” Dockery said. “It’s really about shifting the liability off CSX and onto the backs of taxpayers of the state of Florida.” She offered amendments to the bill Wednesday to strip out “rail yards” from the areas where accidents would be covered. Dockery said without it, Florida taxpayers “will be on the hook for accidents occurring in CSX’s rail yard, which have nothing to do with commuter rail.” The amendment failed 6-3, although Siplin voted for it – then asked that he be consulted more by the sponsor, Sen. Lee Constantine, R-Altamont Springs. She also offered an amendment unsuccessfully to put more teeth in the proposal that the state work to mitigate the heavy rail traffic through Lakeland. Constantine said he had an agreement with the city to fully address their concerns by the time the bill gets to the Senate floor.

The Politics

The cast of characters has changed from last year, when the Florida Senate refused to make taxpayers pay for the negligence of a freight railroad using our tracks. Again this year, the CSX deal will likely be decided in the Senate, where committees appear stacked for the Fortune 500 company. Sadly, the people’s governor has yet to give voice to the concerns of average Floridians.
